STJ endorses the use of SERP-JUD as a useful tool in civil enforcement proceedings

On April 7, the 4th Panel of the STJ granted Special Appeal No. 2.226.101/SC and authorized the use of the Electronic Public Records System (SERP-Jud) for the benefit of creditors/plaintiffs in the search for assets subject to attachment in civil proceedings.

SERP-JUD is the exclusive access module for the Judiciary and Public Administration Agencies within the Electronic Public Records System (SERP), established by Federal Law No. 14,382/2022, which created a single platform for accessing civil registry services, real estate registry, registry of titles and documents, and legal entities.

The STJ’s precedent comes at an opportune time and consolidates an understanding that had already been developing within the TJSP—which, as exemplified by the recent AI 2402173-24.2025.8.26.0000 (11th Chamber of Private Law, Reporting Judge Marco Fábio Morsello, dated April 9, 2026), had been overturning lower court decisions that denied the request on the grounds that ‘it could be carried out by the interested party themselves, without the need for judicial intervention.’

Although access to such registry services is public and, in theory, available to any interested party in a decentralized manner across various locations, it is undeniable that centralized consultation enhances the efficiency and accuracy of asset searches and debt enforcement measures.

Furthermore, the use of SERP-JUD does not violate the debtor’s rights, does not imply an automatic breach of confidentiality, and is always subject to judicial oversight.
