Experiences

André has worked as a corporate labor lawyer for more than a decade, including renowned law firms. He was a member of the Relationship Commission with the Regional Labor Court of the 2nd Region of the OAB/SP. Member of the Corporate Labor Law Study Group (GEDTE) and the Brazilian Sports Law Institute. He has extensive experience in collective and individual labor law, advisory and litigation, providing services to national and multinational companies from various sectors of the economy.

 

Track record

– Advised a multinational company, a leader in the technology sector, in a public civil action concerning the obligation to pay for the health insurance of retired ex-employees.

– Advised a company in the sugar-alcohol sector, which has more than 15,000 employees, in a public civil action filed by the Labor Prosecutor’s Office in the state of São Paulo, related to compliance with quotas for people with disabilities and apprenticeships.

– He advised a well-known telecommunications company, which has more than 6,000 employees, in a public civil action filed by the Labor Prosecutor’s Office in the state of São Paulo, requesting obligations to do and not to do related to moral harassment.

– Advised a well-known metallurgical company in the interior of the state of São Paulo in a rescission action aimed at overturning a conviction in a final and unappealable labor claim that ordered a worker to remain in his job until his retirement, as well as the payment of a large amount of compensation, due to a flaw in the procedural instruction phase. He was successful before the Regional Labor Court of the 15th Region in rescinding the decision and ordering the reopening of the procedural instruction.

– Representation of companies from various sectors, such as technology, metallurgy and the third sector, in civil inquiries within the scope of the Regional Labor Prosecutors’ Offices related to investigations into issues such as pejotization, occupational health and safety standards, working hours and work in conditions analogous to slavery.

– He has prepared legal opinions for companies in the sugar-alcohol sector on measures and alternatives to mitigate risks related to liability for work in conditions analogous to slavery.

– He has advised foreign companies on formalizing employment contracts in Brazil, implementing policies and structuring forms of remuneration and working hours.

– He has participated in numerous integration processes between companies after M&A operations, mainly in the commerce, technology and agribusiness sectors, working to prevent labor liabilities arising from the equalization of salaries and benefits.

– He repeatedly represents financial institutions and means of payment companies in collective bargaining negotiations with the respective unions, including for the purposes of implementing collective agreements on Profit Sharing (PLR).
