Before FLH was founded, Aldo worked at two renowned law firms for approximately 20 years and was the partner in charge of the labor area at both firms. He has international experience at Proskauer Rose LLP in New York. He was an assistant professor on the undergraduate and postgraduate courses in material and procedural labor law at the Pontifical Catholic University of São Paulo – PUC/SP. Member of the Trade Union Law Commission of the OAB/SP. Member of the Labor Law Committee of the São Paulo Lawyers Institute (IASP). Former coordinator of the Corporate Labor Law Study Group (GEDTE). He has extensive experience in collective and individual labor law, advisory and litigation, providing services to national and multinational companies from various sectors of the economy.

 

Track record

– Advised one of the largest agribusiness investment funds in third-party motions filed before the Labor Courts, which were successful in overturning the seizures made by labor creditors on precarious debt assigned in trust to the investment fund in amounts exceeding R$ 200MM

– Advised a company in the sugar-alcohol sector which has more than 15,000 employees in a public civil action filed by the Public Labor Prosecutor’s Office in the state of Minas Gerais related to various issues involving working hours, reversing obligations to do and not to do that were granted in a sentence.

– He represented the interests of a company in the technology sector in a public civil action that sought to prohibit the collective dismissal of workers without prior negotiation with the union (STF issue 638).

– Advised a well-known metal company in the interior of the state of São Paulo in a lawsuit in which the union claimed the nullity of the mass dismissal and reinstatement of the workers. He was successful before the Superior Labor Court in suspending the injunction for the reinstatement of the workers and subsequently advised the metal company in reaching an agreement with the union and the dismissed workers.

– Acting in a public civil action that deals with the obligation of investment funds acquiring labor credit rights to communicate the assignment within the scope of the labor claims themselves, having successfully obtained the annulment of an injunction before the Regional Labor Court of the 15th Region

– Prepared a legal opinion for a federal public company on the labor risks involved in changing the job and salary plan and modifying commissioned and bonus positions.

– Advised a financial institution on structuring a complex long-term incentive plan.

– He has participated in numerous integration processes between companies after M&A operations, mainly in the commerce, technology and agribusiness sectors, working to prevent labor liabilities arising from the equalization of salaries and benefits.

– Advised a multinational company in an administrative proceeding before CADE involving alleged unfair competition due to the exchange of sensitive information and the setting of salaries and benefits in meetings held by HR groups.

– He repeatedly represents financial institutions and means of payment companies in collective bargaining negotiations with their respective unions, including for the purposes of implementing collective profit-sharing agreements.
